Content

This service includes submitting an objection (application) to the Appellate Council of the Intellectual Property Agency of the Republic of Azerbaijan, which hears disputes in the field of industrial property protection, regarding the following issues: a) objections to the decision to refuse to grant a patent to an invention, utility model, or industrial example; b) objections filed against published claim documents on inventions, utility models and industrial samples; c) objections received in connection with the granted patent; ç) disputes arising on patent invalidation according to Article 37 of the Law of the Republic of Azerbaijan "On Patents"; d) disputes arising in connection with the originality; e) objections against the rejection decision made during the initial examination of claim documents on trademark, geographical indication; e) to objections against the decision of refusal accepted by the expert according to the claim documents about the trademark, geographical indication; f) objections to the registration of a trademark, geographical indication; g) objections against the trademark registered in violation of relevant and other grounds; g) objections submitted in connection with the termination of registration if the trademark has not been used continuously for 5 years from the date of registration; h) objections given in connection with the attestation, registration and activity of patent attorneys; x) applications for widespread recognition of a trademark and objections filed against a widely recognized trademark; ı) objections to the cancellation of the certificate for the use of the geographical indication; i) in any of the states that are parties to the Paris Convention on the protection of industrial property, disputes arising in connection with the registration of a person directly or indirectly related to the owner of the trademark, representative in the name of the agent, in violation of the requirements of article 6 septies of the Convention in the Republic of Azerbaijan.
